Our department is the central policy and coordinating element of the Attorney-General's portfolio and provides advice to the Attorney-General and the Minister for Justice and Minister Assisting the Prime Minister on Counter-Terrorism.

Our department provides legal services, including constitutional advice, to government and agencies of government. We develop and implement policies and programmes to maintain and improve Australia’s legal and justice systems. We coordinate national security and emergency management policies and practices. The department also represents the Government in national and international legal, justice, security or emergency-related matters and forums.

The Office of the Solicitor-General was established under the Law Officers Act 1964. The Solicitor-General is the second law officer of the Commonwealth. The Law Officers Act sets out the functions of the Office, which include acting as counsel for the Commonwealth, giving opinions on questions of law to the Attorney-General, and carrying out such other functions ordinarily performed by counsel, as the Attorney-General requests.

The Solicitor-General has an office based within the Attorney-General's Department in Canberra along with chambers in Melbourne.  This position (together with the other Counsel Assisting position) is to be based in the Canberra office, although some travel may be required.


The Counsel Assisting the Solicitor-General will provide high level support to the Solicitor-General.  As second law officer of the Commonwealth, the Solicitor-General provides written and oral advice on matters of significance to the Australian Government and appears as counsel in cases of constitutional significance, international cases and other cases of special government interest.  We are seeking applicants with the following attributes to join us in supporting the Solicitor-General:

  • Ability to assist in the preparation of the cases in which the Solicitor-General is briefed as counsel and appear as junior counsel in selected cases where appropriate.
  • Litigation and advising experience preferably specialising in matters of Australian public law.
  • Highly developed written and research skills with the ability to prepare legal opinions, speeches and presentations for internal and external conferences.
  • Demonstrated ability to apply professional judgement, communicate with influence and effectively achieve quality outcomes within tight timeframes.
  • Highly developed interpersonal skills and the ability to build productive relationships with internal and external stakeholders.
  • Demonstrated ability to work efficiently and effectively within a small team environment.
  • Post-graduate qualification in law and/or High Court associateship would be an advantage.


  • Applicants must be Australian citizens to be eligible for employment at the Attorney-General’s Department.
  • The preferred applicant will be required to successfully undergo a police record check and be able to obtain and maintain a Negative Vetting Level 1 security clearance. The preferred applicant must be willing to disclose all relevant and required information.
  • Successful applicants engaged into the APS will be subject to a Probationary period.
  • A degree in law from an Australian tertiary institution or a comparable overseas qualification, preferably with 1st class Honours (or equivalent)
